Community Property - Washington Intestate Division

 

Although some states, such as Texas, determine disposition of the decedent's community based upon whether the surviving spouse is also a parent to all of the decedent's children, Washington simply grants the surviving spouse all of the decedent's community property. 

 

If the decedent has a surviving spouse, the surviving spouse receives all of the community property, even if the decedent has living children.
