Half-Blood Relations: Mississippi

 

A half-blood relation is any person related to you by just one common ancestor, when he or she could otherwise be related to you by two common ancestors.  The same designation applies to any two people at the same level of relation to one another (cousin, aunt, etc.) who could be related by two common ancestors, but are not.

 

Mississippi's intestacy laws have a unique set of instructions for the treatment of half-blood relations:  half-siblings, half-nieces, and half-nephews are treated exactly the same as whole blood relations at the same level.  Beginning with aunts and uncles, half-blood relations do not receive any of the intestate estate if there are any whole blood relations at the same level of relation.

 

From this point forward when using the Mississippi Intestacy Calculator™, if any class of relatives has both whole and half-blood relations, exclude the half-blood relations when entering the number of people who living.  If, however, there are only half-blood relations at any particular class of relative, you will include them all when entering the number of people.

 

For example, you have two whole blood aunts, one whole blood uncle, and one half-aunt: You will answer "3" as the number of living aunts and uncles, excluding the half-aunt.  If the one half-aunt was the only living relation this level, she is entitled to a portion of the intestate estate: You will answer "1" as the number of living aunts and uncles.

 

The following definitions provide some understanding of half-blood relations, but the 'split' between whole and half-blood relation may have occurred at a more distant relation than the half-blood relation's own parents.

 

Half-Aunt / Half-Uncle

Any person who shares just one common parent with your parent.  (If your grandmother had a child with anyone other than your grandfather, that child is your half-aunt or half-uncle.  The same applies if your grandfather had a child with anyone other than your grandmother.)

 

Half-Great-Aunt / Half-Great-Uncle

Any person who shares just one common parent with one of your grandparents.  (If your great-grandmother had a child with anyone other than your great-grandfather, that child is your half-great-aunt or half-great-uncle.  The same applies if your great-grandfather had a child with anyone other than your great-grandmother.)

 

Half-Great-Great-Aunt / Half-Great-Great-Uncle

Any person who shares just one common parent with one of your great-grandparents.  (If your great-great-grandmother had a child with anyone other than your great-great-grandfather, that child is your half-great-great-aunt or half-great-great-uncle.  The same applies if your great-great-grandfather had a child with anyone other than your great-great-grandmother.)

 

Half-Cousin

Any person who has a parent that is your half-aunt or half-uncle.

 

Half-Second Cousin

Any person who has a parent that is your half-blood great-aunt or half-blood great-uncle.
